Since January 1, 2003, these rules have been recommended for application by the Federal Association of German Industry, the Federal Association of German Wholesale and Foreign Trade, the Federal Association of German Forwarding and Logistics, the Conference of the German Chamber of Industry and Commerce and the Federal Association of German Retailers.
Therefore we operate exclusively in accordance with the latest version of the ADSp - (German Forwarder´s Terms and Conditions of Trading). These limit in § 23 ADSp the legal liability for damage to goods in the case of damage to goods whilst in the care of a forwarder to EUR 5 / kg, in accordance with § 431 of the German Commercial Code (HGB), in the case of multimodal transports, including sea transports to 2 SDR (special drawing right) / kg plus, in addition, per damage or event to EUR 1 Millions or EUR 2 Millions respectively, or 2 SDR / kg whichever is greater. Paragraph 27 ADSp does not constitute an agreement for alternative maximum liability sums concerning § 25 of Montreal Agreement.
